These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and WindowsVPS.pk ("we", "us", "our"). By creating an account, placing an order, or using any WindowsVPS.pk service, you agree to be bound by these Terms in their entirety. If you do not agree, do not use our services.
You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our services. By registering an account, you represent that you meet this requirement and that all information you provide is accurate, current and complete.
You are solely responsible for all activity under your account. Keep your login credentials secure. If you suspect unauthorized access, notify us immediately via WhatsApp or a support ticket at my.windowsvps.pk. We are not liable for losses caused by unauthorized account access due to your failure to secure your credentials.
WindowsVPS.pk provides unmanaged virtual private server (VPS) and remote desktop (RDP) services across multiple global locations. All services are delivered on KVM virtualization with NVMe SSD storage.
We manage hardware, network, power and KVM hypervisor. You manage the operating system, software, security, firewall, updates, user accounts and backups inside your virtual machine.
Services are provided "as is" and "as available". We do not guarantee fitness for any particular purpose. It is your responsibility to verify that our services meet your specific requirements before purchasing.
A VPS with a specific country IP does not guarantee account approval, ranking improvement, trading performance, or access to any third-party platform or service.
Server locations, hardware specifications, IP availability and plan configurations may change. We reserve the right to modify available locations, plans and pricing at any time.
All services are billed on a monthly prepaid basis unless stated otherwise. Payment is due before service activation or renewal. Services are not provisioned until payment is verified and confirmed.
WindowsVPS.pk reserves the right to change prices at any time. Active customers will receive at least 30 days notice before any price increase takes effect on their current services. New orders are subject to current pricing at the time of purchase.
All WindowsVPS.pk plans include fair CPU usage by default. Your VPS runs on shared physical hardware alongside other customers' virtual machines. While KVM provides dedicated RAM and storage, CPU time is shared across all VMs on the host node.
If your VPS consistently consumes excessive CPU resources that degrade performance for other customers on the same node, WindowsVPS.pk reserves the right to throttle, suspend, or terminate your service without prior notice and without refund.
Fair usage means your VPS should not sustain 100% CPU utilization for extended periods unless your plan explicitly guarantees dedicated CPU cores. Short bursts of high CPU usage (compiling, updates, batch processing) are normal and expected. Sustained high CPU usage that impacts other customers is not permitted.
Normal application workloads, RDP sessions, web hosting, trading software, business applications, databases, development, and occasional high-CPU tasks like updates or batch jobs.
Cryptocurrency mining, sustained 100% CPU for hours/days, CPU stress testing, torrent seeding, brute-force attacks, password cracking, or any workload that degrades other customers' performance.
We monitor host-node CPU usage to ensure fair distribution. If your VPS is flagged, we may contact you to reduce usage. Repeated or severe abuse results in suspension without warning.
Bandwidth is listed as "unmetered" — this means no per-GB billing, not unlimited throughput. Sustained full-speed transfers that degrade other customers may be throttled. Port speed is as listed per plan.
The following activities are strictly prohibited on all WindowsVPS.pk services. Engaging in any of these will result in immediate suspension or termination without notice, without refund, and may be reported to relevant authorities.
This is not an exhaustive list. WindowsVPS.pk reserves the right to determine, at its sole discretion, whether any activity violates these Terms or our Acceptable Use Policy. For the complete list of prohibited activities, see our AUP.
WindowsVPS.pk reserves the right to suspend, restrict, or terminate any service at any time, with or without prior notice, for any of the following reasons:
Violation of these Terms, the AUP, or any other WindowsVPS.pk policy results in immediate suspension or termination without notice and without refund.
Excessive CPU, network, or storage usage that degrades performance for other customers. We may throttle first or suspend immediately depending on severity.
Failure to pay for renewal results in service suspension. After a grace period, the service and all data will be permanently deleted without further notice.
Valid abuse reports, DMCA notices, law enforcement requests, or court orders may require immediate suspension of your service.
Chargebacks, payment fraud, identity fraud, or providing false account information results in permanent termination and a ban from all future services.
If your VPS threatens the stability, security, or performance of our infrastructure or other customers' services, we may act immediately without prior notification.
If your service is suspended or terminated due to a violation of these Terms, the AUP, or any other policy, no refund, credit, or compensation will be provided. This applies regardless of remaining time on your billing cycle. All data on the terminated service will be permanently deleted.
You are solely responsible for all data stored on your VPS. WindowsVPS.pk does not perform automatic backups, does not guarantee data preservation, and is not liable for any data loss.
IP addresses assigned to your VPS remain the property of WindowsVPS.pk and its upstream providers. They are licensed to you for the duration of your active service only.
WindowsVPS.pk guarantees 99.9% monthly infrastructure uptime as detailed in our Service Level Agreement. The SLA covers infrastructure availability only — hardware, network, power and KVM hypervisor. It does not cover software, OS, or application issues within your virtual machine.
Service credits are the sole remedy for SLA breaches. Credits must be claimed within 7 days. Full details, exclusions and credit tiers are in the SLA page.
WindowsVPS.pk does not manage, endorse, or guarantee compatibility with any third-party platform, marketplace, software, or service. This includes Amazon, eBay, Forex brokers, freelancing platforms, social media networks, payment processors, and any other service not operated by WindowsVPS.pk.
You are solely responsible for complying with the terms of any third-party service you use on your VPS. If a third-party platform suspends or restricts your account for any reason — including IP-related issues — this does not constitute grounds for a refund, credit, or service complaint against WindowsVPS.pk.
To the maximum extent permitted by applicable law, WindowsVPS.pk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
WindowsVPS.pk's total aggregate liability for any claim arising from or related to your use of our services shall not exceed the amount you paid for the affected service during the one (1) month period immediately preceding the claim. Service credits under the SLA are your sole remedy for infrastructure downtime.
You agree to indemnify, defend, and hold harmless WindowsVPS.pk, its owners, employees, partners, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of our services, your violation of these Terms, your violation of any third party's rights, or any content you host or transmit through our infrastructure.
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.
We may share your information with law enforcement, regulatory authorities, or third parties when required by law, in response to legal process, or to protect our rights, property, or safety.
WindowsVPS.pk reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email to registered customers or by updating this page. The "Last Updated" date at the top of this page reflects the most recent revision.
Continued use of our services after changes are published constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using our services and cancel your account before the next billing cycle.
These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from or related to these Terms or your use of our services shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Lahore, Pakistan.
